Requirements for Apostille Services
To ensure your documents can be apostilled and accepted abroad, there are specific requirements depending on the type of document. Below, we outline the necessary steps for both Vital Records and Non-Vital Records.

Vital Records Apostille
A Vital Record includes documents such as birth certificates, marriage certificates, and death certificates. These documents must meet the following criteria to qualify for apostille services:
The document must be a certified copy issued by the county where the event (birth, marriage, or death) was recorded.
The document will state “Certified Copy of Vital Record” at the bottom to confirm its authenticity.
Common Uses:
Apostille of vital records is commonly required for international purposes such as immigration, marriage abroad, adoption, or legal matters involving foreign governments.

Non-Vital Record Apostille
Non-Vital Records include documents such as diplomas, certifications, powers of attorney, corporate documents, and court judgments. These documents must meet the following criteria:
The document must be certified by a Notary Public* before it can be submitted for apostille.
Educational records (diplomas, transcripts) must be signed and certified by the school or educational institution before notarization.
Common Uses:
Apostille of non-vital records is often required for business transactions, employment abroad, visa applications, and international legal proceedings.
* – Notary Acknowledgement or Jurat
Any document requiring notarization (such as affidavits, powers of attorney, or business documents) must have a valid Notary Acknowledgment or Jurat attached. This verifies that the document was properly notarized and is ready for international certification.
Federal Apostille Services
At Gina Averina Document Services, we also offer Federal Apostille Services for documents that originate from federal agencies of the United States government. These types of documents require certification at the federal level to be recognized internationally in countries that are part of the Hague Apostille Convention.
Types of Documents That Require a Federal Apostille:
The process for obtaining a federal apostille generally takes longer than state-level apostilles, typically around 8-10 weeks.

Both types of apostilles certify the authenticity of the document for international use, ensuring that it is recognized as legally valid in foreign countries that are part of the Hague Apostille Convention.
Difference Between State-Level and Federal Apostille
State-Level Apostille:
A state-level apostille is used for documents that originate from within a specific state (e.g., birth certificates, marriage certificates, academic transcripts). These are issued by the Secretary of State or another designated state authority.
Federal Apostille:
A federal apostille is required for documents issued by U.S. federal agencies (e.g., FBI background checks, INS documents). These apostilles are issued by the U.S. Department of State.

What is an Apostille?
An Apostille is an official certification that authenticates the signature of a public official on a document for use in foreign countries that are members of the 1961 Hague Convention. Apostilles are commonly required for documents such as birth certificates, marriage certificates, court orders, and diplomas, ensuring that they are legally recognized abroad.
What Does an Apostille Certify?
An apostille verifies three key elements of your document:
- The authenticity of the signature of the public official who signed the document.
- The capacity in which that public official acted (for example, a notary public or government official).
- When applicable, the identity of the seal or stamp that the document bears, ensuring its legitimacy.
It’s important to note that while an apostille certifies the validity of the signature or seal, it does not validate the content of the document itself.
Who Can Request an Apostille?
Anyone can request an apostille for a document, whether it’s for themselves or on behalf of someone else. You don’t need to be related to the person whose name is on the document. For example, if a friend or neighbor is unable to submit their documents personally, you can submit the request on their behalf.
When Do You Need an Apostille?
You need an apostille if you plan to use a U.S. public document in a foreign country that is part of the Hague Convention. For instance, if you’re getting married abroad, applying for a visa, or dealing with international business transactions, your documents may require an apostille to be legally recognized.
Documents that frequently require apostilles include:
- Birth, Marriage, and Death Certificates
- Power of Attorney
- Diplomas and Transcripts
- Corporate Documents
- Court Orders and Judgments
If you’re unsure whether your document requires an apostille, feel free to contact us, and we’ll guide you through the process.

FAQ
Can I get an apostille for a copy of my document or do I need the original?
In most cases, an apostille must be issued for an original document or a certified copy. Some documents, such as birth certificates and marriage certificates, must be certified copies issued by the relevant state authority. However, notarized copies of certain documents, like diplomas or power of attorney, can also be apostilled.
How long does it take to get an apostille?
The time frame for receiving an apostille depends on whether it is a state-level or federal apostille. For state-level documents, the process usually takes about 2-5 business days, but federal apostilles typically take longer, around 8-10 weeks. Expedited services may be available depending on your location and the type of document.
Can you help with translation and notarization of foreign documents?
Yes, we provide certified translation services for documents that must be translated into English before apostille processing.
We can also notarize the translator’s signature, ensuring your documents meet all the requirements for certification and apostille.
Do I need to be present to request an apostille?
No, anyone can request an apostille on your behalf. You do not need to be present, and a friend, family member, or colleague can submit the necessary documents for you.
What is the difference between an apostille and authentication?
An apostille is used for documents being sent to countries that are members of the Hague Convention. If the country is not a member, your document will require authentication instead of an apostille. Authentication involves additional steps, including certification by the embassy or consulate of the destination country.
